specific requirements or that it will be uninterrupted, error-free, or secure.
● Accuracy of Information: We do not warrant the accuracy, reliability, or completeness
of any information provided through the App.
● Third-Party Post: We are not responsible for any third-party Post or materials, including
their legality, accuracy, or availability.
12.2 Limitation of Liability: To the maximum extent permitted by law, CMF, its affiliates,
partners, officers, directors, employees, and agents shall not be liable for any indirect,
incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or
use, arising out of or related to your use of or inability to use the App, even if we have been
advised of the possibility of such damages. Our total liability to you for any claims arising out of
or related to the App shall not exceed the amount you paid us, if any, during the three (3)
months prior to the event giving rise to the claim.
12.3 Exclusions and Limitations: Some jurisdictions do not allow the exclusion of certain
warranties or the limitation or exclusion of liability for incidental or consequential damages.
Accordingly, some of the above limitations may not apply to you. In such cases, our liability will
be limited to the fullest extent permitted by applicable law.
13. Dispute Resolution
13.1 Governing Law: These Terms shall be governed by and construed in accordance with the
laws of the Republic of India, without regard to its conflict of law principles.
13.2 Informal Resolution: Before initiating any legal action, You agree to first contact us at
legal@checkoutmyfriend.link to attempt to resolve the dispute informally. We will attempt to
resolve the dispute through communication and negotiation in good faith within 90 days of Your
notice.
13.3 Arbitration: If the dispute cannot be resolved informally, it shall be finally resolved by
binding arbitration. The arbitration shall be conducted in accordance with the Indian Arbitration
and Conciliation Act, 1996, as amended, and the venue of arbitration shall be Guwahati, Assam,
India. The language of the arbitration shall be English. The arbitrator’s decision shall be final
and binding, and judgment on the award rendered by the arbitrator may be entered in any court
of competent jurisdiction.
13.4 Waiver of Class Action Rights: You agree that any disputes arising under these Terms or
in connection with the App shall be resolved on an individual basis and not as part of any class,
collective, or representative action. You expressly waive your right to participate in any class
action or collective lawsuit.
13.5 Injunctive Relief: Nothing in these Terms shall prevent either party from seeking injunctive
or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened
